These Terms of Service explain the rules, rights, and responsibilities that apply when you use SolTheWorld LLC's website, book a service, create an account, request a quote, schedule a shoot, or use any SolTheWorld deliverables.
By using our website, submitting a booking request, creating an account, approving a quote, paying an invoice, or using our services, you agree to these Terms.
1. Parties
These Terms are between SolTheWorld LLC ("SolTheWorld," "we," "our," "us," or "Provider") and the person, business, property owner, listing agent, property manager, broker, company representative, or authorized party using our website or booking our services ("Client," "you," or "your").
You confirm that you are at least 18 years old and have the authority to request services for the property or project involved.
If you are booking on behalf of a property owner, business, brokerage, landlord, property manager, tenant, seller, or third party, you confirm that you have permission to do so.
2. Scope of Services
SolTheWorld provides real estate media, property marketing, digital twin, and visual documentation services.
Services may include, but are not limited to:
Premier photography
Walkthrough videos
Highlight reels
3D virtual tours
Floor plans
Virtual staging
Virtual twilight edits
Branded property webpages
3D point cloud or property documentation files
Digital delivery links
Hosted media experiences
Related consulting, setup, or digital presentation services
The exact services provided depend on the package, add-ons, booking selections, invoice, written quote, or custom agreement approved by the Client.
3. Website Use and Accounts
You may use the SolTheWorld website to view services, explore pricing, submit contact forms, create an account, schedule a booking, manage project information, and access future customer dashboard features.
You are responsible for keeping your account login information secure.
You agree not to misuse the website, attempt unauthorized access, interfere with website security, scrape data, submit false information, or use the website for unlawful purposes.
SolTheWorld may suspend or restrict access to accounts, bookings, or website features if we believe there is misuse, fraud, abuse, unauthorized access, or violation of these Terms.
4. Booking Requests
Submitting a booking request through the website does not guarantee final acceptance, availability, or project approval.
A booking request may require review, confirmation, payment, additional information, scheduling coordination, or manual approval before the project is considered fully confirmed.
SolTheWorld may decline, reschedule, or request clarification for a booking when necessary due to availability, travel distance, property conditions, incomplete information, safety concerns, service limitations, or other business reasons.
5. Property Access and Authorization
The Client grants SolTheWorld permission to enter, photograph, scan, record, document, and capture media of the property at the scheduled time.
The Client is responsible for making sure the property is accessible and that all required owners, tenants, occupants, agents, property managers, business representatives, or other authorized parties have approved the scheduled media capture.
The Client is responsible for providing accurate access instructions, including lockbox codes, gate codes, parking instructions, unit numbers, entry details, contact information, and any special property notes before the appointment.
If SolTheWorld cannot access the property at the scheduled time, additional fees, rescheduling fees, or cancellation fees may apply.
6. Property Readiness
The Client is responsible for making sure the property is clean, prepared, accessible, safe, and photo-ready before SolTheWorld arrives.
This may include:
Cleaning and staging the property
Turning on lights
Opening blinds or curtains
Securing pets
Notifying occupants
Removing clutter
Removing private or sensitive items
Ensuring utilities are working
Making sure all requested rooms or areas are accessible
SolTheWorld is not responsible for cleaning, staging, moving furniture, hiding personal items, or preparing the property unless agreed in writing.
Items visible at the time of capture may appear in the final media. The Client is responsible for removing anything they do not want shown.
7. Property Release and Media Capture Permission
The Client grants SolTheWorld, its employees, contractors, vendors, and service providers permission to capture, process, edit, reproduce, display, host, distribute, and create derivative works from property media for the purpose of providing the requested services.
This permission may include capturing interior spaces, exterior spaces, surrounding property areas, property features, floor plans, 3D scans, photos, videos, digital models, and related media.
The Client confirms that posting, sharing, or using the delivered media will not violate any property owner agreement, tenant agreement, HOA rule, MLS rule, privacy rule, platform policy, lease agreement, or law.
8. Fees, Payment, and Taxes
Fees are based on the selected package, add-ons, custom quote, invoice, written proposal, or approved booking details.
Prices may vary based on property type, property size, selected services, number of photos, unit count, travel, add-ons, complexity, rush delivery, hosting, or custom requirements.
Applicable taxes may be added where required.
Payment terms will be provided at booking, invoice, quote, or project approval.
SolTheWorld may withhold delivery, downloads, hosted access, account access, or continued service until payment is received.
Late payments, failed payments, additional visits, extra editing, out-of-scope requests, extended hosting, or rescheduling may result in additional fees.
9. Cancellations, Rescheduling, and Refunds
Cancellations, rescheduling, refunds, failed access appointments, property-readiness issues, and short-notice changes are handled according to SolTheWorld's Refund & Cancellation Policy.
Because SolTheWorld provides custom, property-specific media services, refunds may be limited once capture, editing, production, or digital delivery work has started.
If a client cancels, reschedules, or fails to provide access with short notice, a cancellation fee, rescheduling fee, travel fee, or additional visit fee may apply.
10. Digital Delivery and Fulfillment
Deliverables are usually provided electronically through email, secure links, downloadable files, hosted tour links, branded property webpage links, client account access, or third-party media platforms.
Delivery timelines, hosting access, revisions, downloadable files, platform access, and retention of deliverables are handled according to SolTheWorld's Digital Delivery / Fulfillment Policy.
Delivery is considered complete when the files, links, hosted media, or access instructions are sent to the Client or made available through the agreed delivery method.
11. Ownership of Media
Unless otherwise agreed in writing, SolTheWorld retains ownership and copyright of all media, digital assets, photos, videos, 3D tours, floor plans, edited files, models, property webpages, visual assets, and derivative works created by SolTheWorld.
Payment for services does not transfer copyright ownership to the Client.
Instead, SolTheWorld grants the Client a limited license to use the delivered media as described in these Terms.
12. Client License to Use Deliverables
After full payment is received, SolTheWorld grants the Client a limited, non-exclusive, non-transferable license to use the delivered media for marketing, promoting, leasing, selling, documenting, or presenting the specific property or project for which the media was created.
This license may allow use on:
MLS listings
Real estate websites
Brokerage websites
Property management platforms
Rental platforms
Social media
Email marketing
Printed marketing materials
Client-owned marketing channels
This license applies only to the original property or project unless SolTheWorld gives written permission for additional use.
13. Restrictions on Use
The Client may not sell, transfer, resell, sublicense, give, or distribute SolTheWorld-created media to another agent, brokerage, builder, vendor, marketing company, property owner, or third party for unrelated use without written permission from SolTheWorld.
The Client may not use the media for a different property, unrelated listing, new campaign, new agent, new builder, new owner, or third-party commercial purpose without written permission.
The Client may not claim ownership of SolTheWorld-created media, remove required branding, misrepresent the media, or use the media in a misleading, unlawful, or deceptive way.
Reuse for a relisting, new agent, new company, third-party campaign, builder promotion, or unrelated commercial purpose may require a new license, additional fee, or new shoot.
14. Portfolio and Marketing Use by SolTheWorld
Unless the Client requests otherwise in writing before the project begins, SolTheWorld may use selected media, screenshots, project examples, behind-the-scenes content, or completed deliverables for portfolio, marketing, education, social media, website, sales, and promotional purposes.
SolTheWorld will use reasonable care not to display sensitive personal information, private documents, security codes, or clearly private items.
If the Client has privacy concerns about portfolio use, they should notify SolTheWorld in writing before the scheduled shoot.
15. Third-Party Platforms
Some services and deliverables may rely on third-party platforms for hosting, processing, scheduling, authentication, email delivery, SMS delivery, maps, address autocomplete, media hosting, or digital delivery.
These providers may include services such as Matterport, Giraffe360, Treedis, 3DVista, Supabase, Resend, Twilio, Cal.com, Mapbox, Google, Meta/Facebook, and similar providers.
SolTheWorld is not responsible for delays, outages, processing errors, delivery issues, platform changes, account restrictions, hosting limitations, or feature changes caused by third-party providers.
SolTheWorld will make reasonable efforts to assist with third-party access or delivery issues when possible.
16. Floor Plans, Measurements, and Property Data
Floor plans, measurements, square footage, GLA-style reports, 3D models, point clouds, and property documentation files are provided for marketing, planning, visualization, and documentation support.
They are not a replacement for a licensed appraisal, land survey, architectural as-built, engineering report, inspection, code review, or legal measurement unless separately verified by a qualified professional.
The Client is responsible for confirming measurement requirements with MLS rules, lenders, appraisers, architects, contractors, inspectors, property managers, or other professionals where applicable.
17. Virtual Staging and Edited Media
Virtual staging, virtual twilight, object removal, sky replacement, lighting edits, and other visual enhancements are intended to improve property presentation while remaining reasonably representative of the property.
The Client is responsible for making sure edited media is used in compliance with MLS rules, advertising laws, platform policies, disclosure requirements, and professional standards.
SolTheWorld may decline edits that are misleading, unlawful, deceptive, or outside the original scope.
18. SMS, Email, and Customer Communications
SolTheWorld may communicate with Clients through email, phone, SMS, account notifications, booking updates, project updates, and customer support messages.
SMS communication is governed by SolTheWorld's SMS Terms & Consent Policy.
By providing contact information, you agree that SolTheWorld may use that information to communicate about your account, booking request, scheduled shoot, project updates, deliverables, and customer support.
The Client is responsible for providing accurate contact information and making sure any scheduling contact or additional contact has permission to receive project-related updates.
19. Privacy and Data Processing
SolTheWorld collects and processes personal information, booking information, project information, property information, account information, and deliverable-related data according to SolTheWorld's Privacy Policy.
By using our website or services, you agree to the collection and use of information as described in the Privacy Policy.
20. Client Responsibilities
The Client is responsible for:
Providing accurate booking information
Providing accurate property details
Providing accurate contact information
Ensuring property access
Ensuring property readiness
Reviewing delivered media promptly
Reporting delivery issues or correction requests within the stated review period
Maintaining active hosting or account access when applicable
Making sure media use complies with MLS rules, advertising laws, platform policies, tenant privacy rules, owner requirements, and applicable regulations
21. Representations and Warranties
The Client represents and warrants that:
The Client has authority to request services for the property.
The Client has authority to grant access and media capture permission.
The Client's use of the deliverables will not violate MLS rules, HOA rules, lease agreements, privacy rights, platform policies, or applicable law.
The information provided to SolTheWorld is accurate.
Any required owners, tenants, occupants, managers, or representatives have been notified where necessary.
SolTheWorld warrants that services will be performed in a commercially reasonable and professional manner.
22. Insurance
SolTheWorld may maintain business insurance appropriate for its services.
Certificates of insurance may be provided upon reasonable request when available and applicable.
23. Limitation of Liability
To the fullest extent permitted by law, SolTheWorld's total liability for any claim related to a project, booking, service, deliverable, website use, or account access is limited to the amount paid by the Client for the specific project giving rise to the claim.
SolTheWorld is not liable for indirect, incidental, special, consequential, lost-profit, lost-sale, lost-rent, platform-related, reputational, or business interruption damages.
24. No Guarantee of Results
SolTheWorld does not guarantee that media will result in a sale, lease, rental booking, showing, buyer, tenant, offer, higher listing price, faster transaction, or specific marketing result.
SolTheWorld provides professional media and digital presentation services, but results depend on property condition, pricing, market conditions, marketing strategy, platform performance, client use, and other factors outside SolTheWorld's control.
25. Indemnification
The Client agrees to indemnify and hold harmless SolTheWorld from claims, damages, losses, liabilities, costs, or expenses arising from:
The Client's breach of these Terms
Incorrect or incomplete information provided by the Client
Lack of authority to authorize services
Property access disputes
Tenant, owner, HOA, MLS, or platform disputes
Misuse of delivered media
Client negligence or misconduct
Violation of laws, rules, or third-party rights
26. Force Majeure
SolTheWorld is not responsible for delays or failure to perform caused by events outside our reasonable control, including severe weather, natural disasters, illness, emergencies, power outages, internet outages, platform outages, equipment failure, transportation issues, government actions, labor disruptions, or other unforeseen events.
When reasonable, SolTheWorld will work with the Client to reschedule or complete the affected services.
27. Governing Law and Venue
These Terms are governed by the laws of the State of Tennessee, without regard to conflict-of-law principles.
Any legal action related to these Terms or SolTheWorld services shall be handled in the appropriate courts or dispute resolution venue located in or serving Madison County, Tennessee, unless otherwise required by law.
28. Dispute Resolution
Before filing a legal claim, the parties agree to make a reasonable effort to resolve disputes informally.
If the dispute cannot be resolved informally, the parties may pursue mediation, arbitration, or court proceedings as permitted by applicable law and any written agreement between the parties.
29. Changes to These Terms
SolTheWorld may update these Terms from time to time.
The updated version will apply to website use, bookings, purchases, or services made after the updated effective date.
Your continued use of the website or services after changes are posted means you accept the updated Terms.
30. Entire Agreement
These Terms, together with any approved quote, invoice, booking details, Refund & Cancellation Policy, Digital Delivery / Fulfillment Policy, Privacy Policy, and SMS Terms & Consent Policy, represent the agreement between SolTheWorld and the Client for the applicable services.
If there is a conflict between these Terms and a signed written agreement, the signed written agreement will control for that specific project.
